1. Who we are

Nipo Italian is a service provided by Nipo di Nicole Casadio, a sole proprietorship under the Italian "forfettario" flat-rate tax regime (hereinafter "Nipo", "we"). You can contact us at any time at ciao@nipoitalian.com. Our full identifying details (registered address and VAT number) are set out at the end, in section 13.

The service comprises: the website nipoitalian.com, the web application (PWA) nipoitalian.app for learning Italian (levels A0–A2), and live lessons with a teacher.

2. Scope and acceptance

These Terms govern the use of the website, the app and the lesson services. By using the service, creating an account or making a purchase, you accept these Terms. If you do not accept them, please do not use the service.

The service is intended for people aged 16 or over. Minors may use it only with the consent and under the supervision of a person with parental responsibility.

3. Account and registration

To use the app and sync your progress, you create an account with an email address and a password. Authentication and progress storage are handled through Supabase. You are responsible for keeping your credentials confidential and for the activity carried out under your account. How we handle your data is described in our Privacy & Cookie Policy.

4. The app and the licence

The app comes with a free trial for the first 2 weeks. At the end of the trial, full access is unlocked with a single payment of €49 (launch price) / €69 (standard price), which grants lifetime access: it is not a subscription, and there are no automatic renewals or recurring charges.

Upon payment we grant you a personal, non-exclusive and non-transferable licence to use the app and its content for your own personal learning. "Lifetime" access refers to the commercial life of the product: we will keep the app available with reasonable continuity, but the service may evolve or be discontinued (in which case we will give you reasonable notice).

5. Live lessons

In addition to the app, we offer, by booking through cal.com:

Live lessons are a service provided directly by Nicole Casadio. The operational terms for booking, rescheduling and cancellation are set out on the Booking Policy page, which forms an integral part of these Terms.

6. Payments

Nipo uses two separate payment channels, with different counterparties depending on what you buy.

a) App — via Creem (Merchant of Record)

The purchase of app access is handled by Creem (Armitage Labs OÜ, Estonia) as Merchant of Record. This means that, for payment purposes, Creem acts as the seller towards you: it manages the transaction, any applicable tax and the issuance of the purchase receipt/invoice. Nipo grants you the licence to use the app and provides the service. Payments through Creem are also subject to Creem's own terms, which will be presented to you at checkout.

b) Live lessons — via Stripe (direct payment)

Payment for live lessons is made directly to Nipo through Stripe, which acts as a payment service provider (not as a seller). In this case the contractual counterparty and the party issuing the tax document is Nipo di Nicole Casadio.

In short: when you buy the app, your seller for the payment is Creem. When you book a lesson, you buy directly from Nipo. Card details are handled solely by the payment providers (Creem/Stripe): Nipo does not see or store them.

7. Refunds, withdrawal and cancellations

App

For the app you can try the first two weeks of content for free, so you can evaluate the service before buying. On purchase you receive immediate access to the full content: for this reason, by expressly requesting immediate access and waiving your right of withdrawal, all sales are final and no refunds are provided. Payment is processed through Creem (Merchant of Record).

Live lessons

You may reschedule or cancel a lesson at no cost by giving notice at least 24 hours in advance of the booked time. For cancellations with less than 24 hours' notice, or in case of a no-show, the session is deemed delivered and is neither refundable nor recoverable. The Booking Policy applies.

Right of withdrawal (consumers)

If you are a consumer, EU law generally grants you a 14-day right of withdrawal for distance contracts. For digital content and services supplied immediately, this right lapses where, at the time of purchasing the app, you expressly request to begin using it right away and accept that consequence; for this reason the app purchase is non-refundable. Before buying you can still evaluate the service thanks to the two weeks of content available for free. For lessons, if you request their delivery within the withdrawal period, the right of withdrawal may be reduced in proportion to the service already used. Nothing in this section limits the rights the law grants you as a consumer.

8. AI tutor "Ask Nipo"

The app includes a conversational assistant, "Ask Nipo", that helps you practise. To generate its answers, the text of the messages you type into the assistant is sent to a third-party provider, Anthropic (Claude model API), via our servers. Anthropic processes this data as a data processor in order to provide the response; processing takes place on servers located in the United States, with the safeguards required for international transfers. Details are in the Privacy Policy.

Two important things about the AI assistant:

1. Do not enter sensitive or confidential personal data in the chat with Ask Nipo (e.g. health data, credentials, financial information): use it only to practise Italian.

2. The assistant is a support tool and may make mistakes or provide inaccurate information. It does not replace teaching by a qualified instructor, and its responses do not constitute advice of any kind.

9. Acceptable use

You agree not to: resell, share or sub-licence your access; attempt to circumvent security or access measures; use the AI assistant to generate unlawful, offensive or abusive content; or carry out automated activity that overloads the service. We may suspend or close the account in the event of a serious or repeated breach.

10. Intellectual property

All Nipo content — including the "La storia di Montevento" course and its chapters, texts, dialogues, exercises, vocabulary, audio, graphics, images, video, the app and website design, and the Nipo Italian name and logo — is owned by Nipo di Nicole Casadio (or by the respective owners) and is protected by Italian and international copyright law.

Your licence permits personal, individual use for your own learning only. It transfers no ownership or intellectual property rights to you.

You may not, in whole or in part: reproduce, copy, record, screenshot for redistribution, republish, distribute, share, sell, sub-licence, publicly display, translate, adapt or create derivative works from the content; remove or alter any copyright notice; or use the content to build, train or feed any competing product, dataset or AI system. Any use not expressly permitted requires our prior written consent.

Unauthorised use constitutes copyright infringement and a breach of these Terms, and may be pursued through all remedies available under law, including injunctive relief and damages.

11. Limitation of liability

Nipo is a learning tool offered with the utmost care, but we do not guarantee specific results: learning progress depends on many individual factors. The service is provided "as is"; we strive for reasonable continuity but do not guarantee that it will always be free of interruptions or errors. To the extent permitted by law, we are not liable for indirect damages; nothing excludes or limits our liability in cases where this is not permitted by law (including wilful misconduct, gross negligence and liability towards consumers).

12. Governing law, jurisdiction and complaints

These Terms are governed by Italian law. If you are a consumer, the jurisdiction and mandatory protections provided by the law of your country of residence in the EU remain unaffected. For any complaint, write to us at ciao@nipoitalian.com: we always seek an amicable solution. EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform.

14. Changes

We may update these Terms to reflect changes to the service or to the law. The updated version will always be published on this page with its effective date. For material changes that affect you, we will do our best to notify you (e.g. by email or in-app).
